These Website Terms and Conditions ("Terms") govern your access to and use of idortho.com and its pages, forms, search, downloadable materials, embedded media, and features (collectively, the "Website"). The Website is operated by Idaho Orthodontics ("Idaho Orthodontics," "we," "us," or "our").
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website. These Terms concern Website use and do not replace patient treatment agreements, informed-consent documents, financial agreements, our HIPAA Notice of Privacy Practices, authorizations, or other documents that may govern orthodontic care.
Website content is provided for general educational and informational purposes. It is not medical or dental advice, diagnosis, treatment, or a substitute for an in-person evaluation by a qualified professional. Orthodontic needs, treatment options, risks, timing, costs, and results vary by patient.
Do not rely on Website content to make or delay a healthcare decision. Contact a qualified healthcare professional regarding a specific condition or concern. General Website information about braces, Invisalign or other clear aligners, oral hygiene, retainers, imaging, lasers, or emergency comfort measures may not be appropriate for every patient.
Viewing the Website, submitting a callback form, sending a message, calling an office, downloading a form, or receiving a general response does not by itself create an orthodontist-patient or other professional relationship. A provider-patient relationship is established only after Idaho Orthodontics accepts a patient for care and any required examination, consent, and treatment documentation is completed.
A callback, consultation, or appointment request is a request only. No appointment is confirmed until our office communicates confirmation. We may decline, reschedule, or cancel a request as permitted by law and professional obligations.
The Website and its forms are not monitored continuously and must not be used for a medical, dental, or life-threatening emergency.
For a life-threatening emergency, call 911 or go to the nearest emergency department. For an urgent orthodontic concern, call Idaho Orthodontics at 208-237-0005 or the location-specific number provided to you. Do not wait for a Website, email, social-media, or text response when prompt care may be needed.
You must be able to enter a binding agreement to use the Website independently. A parent or legal guardian may use the Website on behalf of a minor or dependent and is responsible for the accuracy of submitted information and the minor's Website use.
The Website is not intended for children under 13 to use independently. A child should not submit a callback or contact form without a parent or guardian's involvement.
You agree not to:
We may restrict or terminate access when we reasonably believe these Terms have been violated or Website integrity, patients, users, or our practice may be at risk.
You agree to provide current, accurate, and complete information. Do not submit false, misleading, defamatory, unlawful, or unnecessarily sensitive content. You are responsible for reviewing form information before submission.
Website transmission is not guaranteed to be error-free or secure. If you do not receive a response or confirmation, call our office. A success screen, automated message, or Website error does not necessarily mean an appointment has been scheduled or a message has been reviewed.
The callback form may request a name, email address, telephone number, and message. Do not use the message field for a detailed medical history, Social Security number, financial-account credentials, or urgent concern.
When you submit contact information, you authorize us to respond about your inquiry or relationship using the contact information provided, including by telephone, email, or text where appropriate. Carrier message and data rates may apply.
Submitting a general Website form does not by itself provide consent to automated or prerecorded marketing calls or texts where separate express consent is required. You may request communication-preference changes, but we may still send non-promotional communications about callbacks, consultations, appointments, care, billing, safety, or legal matters.
Email and ordinary text messages may not be secure. Do not send highly sensitive information through those channels unless our office directs you to an appropriate method.
Our Website Privacy Policy explains Website-related information practices and is incorporated into these Terms by reference. Protected health information may instead be governed by HIPAA, other healthcare laws, and our Notice of Privacy Practices.
The Website Privacy Policy is not a substitute for the Notice of Privacy Practices. Contact our office to request a paper copy. If Website terms conflict with legal rights concerning PHI, applicable law and the Notice of Privacy Practices control.
The Website provides access to a downloadable Authorization for Release of Protected Health Information and Medical Records. The form is provided for convenience and does not guarantee that a request is complete, valid, or received.
Follow the form instructions and contact our office to confirm the approved delivery method. Do not upload or send a completed authorization or patient records through a general Website form. We may require identity, authority, signature, scope, recipient, and other information before processing a records request. Processing is subject to HIPAA, Idaho law, the Notice of Privacy Practices, and applicable fees or response periods.
Website descriptions of treatment, insurance acceptance, financing, in-house payment plans, automatic payments, timing, fees, or cost comparisons are general information and may change. They are not a quote, guarantee of coverage, promise of reimbursement, credit offer, or binding treatment proposal.
Benefits and coverage are determined by the insurer and applicable plan. You are responsible for verifying benefits, exclusions, waiting periods, deductibles, maximums, and other plan terms. Assistance with benefit review or claim submission does not guarantee payment and does not eliminate patient or guarantor responsibility under an applicable financial agreement.
Specific treatment scope, fees, payment obligations, cancellation terms, refund rules, and automatic-payment authorization are governed by the documents provided for the patient's care or transaction. If those documents conflict with these Website Terms on a treatment or payment issue, the specific signed document controls.
The Website may discuss products, brands, or technologies such as Invisalign, Damon braces, 3D cone-beam imaging, digital impressions, 3D printing, or orthodontic lasers. Availability and clinical suitability depend on the patient, location, professional judgment, regulatory status, and other factors.
References to a product or technology do not constitute an endorsement for every patient or a warranty by its manufacturer. Third-party product names and marks belong to their owners. Contact Idaho Orthodontics for an individualized evaluation.
Testimonials, reviews, photographs, videos, and before-and-after examples reflect individual experiences. They are not promises or guarantees that another patient will receive the same outcome. Results depend on diagnosis, anatomy, age, growth, treatment selection, attendance, hygiene, compliance, retainer use, and other factors.
Some content may be edited for length or clarity, identified by a first name or other permitted designation, or used with authorization. Reviews hosted by third parties are subject to those platforms' rules. Ratings and review counts may change after publication.
We aim to provide useful and accurate information but do not guarantee that all content is complete, current, or error-free. Services, doctors, staff, schedules, locations, addresses, technology, insurance relationships, and Website content may change without notice. Images may be illustrative.
We may correct errors, update content, change features, suspend functions, or discontinue any part of the Website at any time. Contact the applicable office to confirm information important to a healthcare, scheduling, insurance, or financial decision.
The Website describes Idaho Orthodontics clinics in Pocatello, Blackfoot, Chubbuck, Soda Springs, and Malad. Clinic days, hours, services, and contact numbers may differ and may change. Some clinics operate within another dental office or on limited days.
Directions and maps are provided for convenience. Verify the location and appointment details with our team before traveling. We are not responsible for errors in a third-party mapping or navigation service.
The Website and its text, graphics, layout, photographs, videos, logos, trademarks, service marks, code, and other content are owned by or licensed to Idaho Orthodontics and are protected by intellectual-property laws.
Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for personal, noncommercial informational purposes. No other right or license is granted.
Idaho Orthodontics names, logos, branding, and related marks may not be used without written permission. Third-party names and marks belong to their respective owners. References to Invisalign, Damon, Google, Meta, Webflow, Vimeo, or other providers do not imply ownership or endorsement beyond the relationship stated.
If you voluntarily provide an idea, suggestion, or general feedback about the Website or our services, you grant us a nonexclusive, worldwide, royalty-free right to use it for legitimate business purposes without compensation or attribution, subject to applicable privacy and healthcare laws.
This section does not give us permission to publicly disclose PHI, confidential patient information, or a private communication contrary to law or an applicable authorization.
The Website may link to or embed services operated by others, including Google Maps, Google reviews, Vimeo, Embedly, Facebook, Instagram, TikTok, YouTube, dental resources, and other websites. Links are provided for convenience and do not mean that we control or endorse all external content, products, security practices, or policies.
Idaho Orthodontics may also contract with SDB and other administrative service providers for marketing, billing, payment or financial administration, compliance, and related business support. Those contracted functions do not make SDB the operator of the Idaho Orthodontics Website or the owner of the Idaho Orthodontics practice.
Your use of an external service is governed by that provider's terms and privacy notice. You assume the risks associated with leaving our Website, subject to rights that cannot lawfully be waived.
We want the Website to be accessible to a broad audience. If you have difficulty accessing content or using a feature, contact us at 208-237-0005. We will make reasonable efforts to provide the information or assistance through an appropriate alternative method.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." IDAHO ORTHODONTICS DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES CONCERNING THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE OR ITS SERVERS WILL BE FREE FROM HARMFUL COMPONENTS. THIS DISCLAIMER DOES NOT APPLY TO WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED AND DOES NOT ALTER OBLIGATIONS ARISING FROM AN ESTABLISHED PROVIDER-PATIENT RELATIONSHIP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IDAHO ORTHODONTICS AND ITS OWNERS, CLINICIANS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO WEBSITE USE OR INABILITY TO USE THE WEBSITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING SOLELY FROM WEBSITE USE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID, IF ANY, SPECIFICALLY TO ACCESS THE WEBSITE DURING THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
These limitations do not apply to liability that cannot lawfully be limited, and they do not limit rights or remedies concerning professional healthcare services under applicable law or a separate patient agreement.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Idaho Orthodontics and its owners, clinicians, employees, and contractors from third-party claims, damages, losses, and reasonable costs arising from your unlawful Website use, your material violation of these Terms, or information you submit without authority.
This section does not require a patient to indemnify us for our professional negligence, violation of law, or conduct that cannot lawfully be shifted to another party.
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Except where applicable law provides otherwise, a dispute arising solely from these Terms or Website use must be brought in a state or federal court with jurisdiction in or serving Bannock County, Idaho, and each party consents to that court's personal jurisdiction.
Before filing a non-urgent Website-related claim, you and Idaho Orthodontics agree to make a good-faith effort to resolve the matter informally by providing written notice and allowing 30 days for a response. This does not prevent either party from seeking emergency injunctive relief, meeting a legal deadline, filing a regulatory complaint, or exercising a right that cannot be limited.
We may suspend, restrict, or terminate Website access at any time when reasonably necessary to protect the Website, users, patients, our practice, or third parties, or to address suspected unlawful activity or a violation of these Terms. Provisions that by their nature should survive termination will survive, including intellectual-property, disclaimer, liability, indemnification, and dispute provisions.
We may update these Terms from time to time. The revised Terms will be posted with a new Last updated date and become effective when posted unless otherwise stated. Your continued use after an update means you accept the revised Terms to the extent permitted by law.
Changes to these Website Terms do not retroactively alter a signed patient treatment or financial agreement unless that agreement and applicable law permit the change.
These Terms, together with the incorporated Website Privacy Policy, are the entire agreement concerning Website use. They do not replace patient-specific agreements or the Notice of Privacy Practices. If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, reorganization, transfer of the Website, or sale of relevant practice assets, subject to applicable law.
Headings are for convenience only. "Including" means "including without limitation." Electronic versions and notices have the same effect as permitted by law.
